These terms are designed to comply with EU Regulation 2016/679 (GDPR) and related Slovak legislation.
2) Scope
This policy applies to personal data processed when using our website and services (the “Services”), in particular:
- registration and management of membership accounts for access to video courses,
- payments and subscriptions,
- comments (displayed only after administrator approval),
- support, communications and marketing (where you have given consent),
- cookies and similar technologies.
3) Data we process
a) Data you provide
- Account: name, email, password (hashed), username/display name.
- Profile (optional): photo/avatar, bio, social links.
- Membership & courses: purchased/planned products, plan type, renewal dates.
- Comments: comment text, display name, timestamps; for security we also store IP address and user‑agent to detect spam/abuse.
- Support: messages, attachments and contact details.
b) Data from third parties
- Payments: payment status, transaction identifiers, billing metadata. We do not store full card numbers.
- Email/marketing: delivery and interaction data (e.g., opens/clicks) – only with consent.
- Analytics/anti‑abuse: aggregated statistics and fraud signals.
c) Data collected automatically
- Technical/usage data: pages visited, session duration, approximate location derived from IP, browser type, OS.
- Cookies & similar tech: see Section 9.
We do not request special categories of data (health, religion, etc.). Please avoid including such data in comments or support.
4) Purposes of processing
- Provide the Services: create/manage account, deliver video courses and membership features, comments, preferences.
- Payments & subscriptions: process transactions, billing, refunds, fraud prevention.
- Comment moderation: comments are published only after admin approval; enforcing community rules.
- Communication: purchase notifications, security and service messages.
- Marketing (with consent): newsletters, offers; you can opt out anytime.
- Improvement & security: analytics, diagnostics, incident monitoring, abuse prevention.
- Legal obligations: accounting, tax, and lawful requests from authorities.
5) Legal bases under GDPR
- Performance of a contract – to provide membership services and courses.
- Legitimate interests – moderation, security, fraud prevention, service improvement (balanced against your rights).
- Consent – required for non‑essential cookies, analytics/marketing, and newsletters.
- Legal obligation – especially accounting and tax laws.
6) Sharing with vendors (general)
We work with a limited set of trusted contracted processors that provide technical and operational support, such as:
- hosting, CDN, databases and infrastructure,
- payment processing and subscription management,
- email delivery and email marketing,
- analytics and error monitoring,
- anti‑spam, anti‑abuse and security services.
These partners process data solely under our instructions, under written agreements (including DPAs) with appropriate technical and organizational measures, and may not use the data for their own purposes. We do not sell your personal data.
Note: The categories of processors are listed in general terms above; specific provider names are available on request where appropriate (e.g., as part of our record of processing activities).
7) International transfers
Where data are transferred outside the EEA/UK, we ensure adequate protection via EU Standard Contractual Clauses (SCCs) and supplementary measures, or transfers to countries with an adequacy decision. You may request copies of relevant safeguards at privacy@vizoftx.com.
8) Retention
We keep data only as long as necessary for the stated purposes:
- Account: while your account is active; certain records may be retained after closure to meet legal obligations (e.g., accounting records typically 10 years under Slovak law).
- Comments: while published and for a reasonable audit/security period.
- Payment records: per legal requirements.
- Marketing consents: until you withdraw consent or the purpose expires.
- Logs/security records: short‑term, longer only when investigating incidents.
After retention ends, we delete or irreversibly anonymize data.
9) Cookies & similar technologies
We use cookies for:
- strictly necessary – login, security, core features,
- functional – remember settings,
- analytics/statistics – only with your consent,
- marketing/personalization – only with your consent.
On your first visit you will see a cookie banner allowing you to accept/reject categories or open Cookie Settings. You can change your choice any time via [Cookie Settings]. Blocking certain cookies may limit functionality.
10) Comments & moderation
- Comments are accepted but published only after admin approval.
- We store comment text, display name, timestamps, IP address and user‑agent for moderation, security and spam prevention.
- We may use automated tools to detect spam/abuse. These tools do not produce legal or similarly significant effects without human review.
- We may refuse to publish or remove comments that violate our rules.
11) Payments & subscriptions
Payments and subscriptions are processed by an external payment provider. We receive limited metadata (e.g., payment status, transaction ID, billing data). We do not store full card numbers. You can manage subscriptions in your account or via the payment provider’s portal.
12) Your rights (GDPR)
Subject to conditions, you have the right to:
- Access your data and obtain a copy,
- Rectify inaccurate/incomplete data,
- Erase data (right to be forgotten),
- Restrict processing,
- Object to processing based on legitimate interests or to direct marketing,
- Data portability,
- Withdraw consent at any time (without affecting past lawful processing).
Send requests to privacy@vizoftx.com. We may require reasonable identity verification. You also have the right to lodge a complaint with the Slovak Data Protection Authority.
13) Security
We implement appropriate technical and organizational measures (TLS in transit, access controls, least‑privilege, updates). No method is 100% secure; we cannot guarantee absolute security.
14) Children’s privacy
The Services are not directed to children under 16. If you believe a child provided data to us, please contact us to request deletion.
15) Automated decision‑making
We do not engage in automated decision‑making that produces legal or similarly significant effects. Automated anti‑spam checks only assist human reviewers.
16) Third‑party links
Our website may contain links to third‑party sites; we are not responsible for their privacy practices. Please review their policies.
17) Changes
We may update this policy from time to time. Material changes will be posted on the website or sent by email. The Last updated date above shows the current version.
